PUBLIC HEARING NOTICE


The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on October 22, 2019 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following items will be on the agenda:

Variance Request from the Elm Creek Cemetery Association within Section 24 of Elm Creek Township. The Elm Creek Cemetery Association is proposing the addition of cemetery plots in an “A” Agricultural District which will be closer to the centerline of the public right-of-way. The Martin County Zoning Ordinance requires a 200 foot setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than 130 feet from the centerline in an “A” Agricultural District.

Variance Request from Paul Grussing within Section 20 of Silver Lake Township. Mr. Grussing is proposing to remove an existing deck and replace it with an enclosed 4-season room. The 4-season room will be closer than the minimum required setback from the Ordinary High Water Level on North Silver Lake in an “SL-2” Shoreland Residential Recreational District. The Martin County Zoning Ordinance requires a minimum setback of 150 feet from a lake/protected water in an “SL-2” Shoreland Residential Recreational District.

Variance Request from Horvath Communications and Verizon Wireless, applicants, and Wendi Russenberger, property owner, within Section 7 of Galena Township. Horvath Communication/Verizon Wireless is proposing to install telecom cabinets adjacent to a wireless communications tower on property located in an “A” Agricultural District which will be closer to the centerline of the public right-of-way. The Martin County Zoning Ordinance requires a 200 foot setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than 130 feet from the centerline in an “A” Agricultural District.

Conditional Use Permit from Donovan McCain (site acquisition consultant for Buell Consulting, Inc.) on behalf of Verizon Wireless, and Neal and Dawn Becker, property owners, within Section 10 of Rutland Township.Verizon Wireless is proposing to install a new 259 foot, self-support wireless communications tower with ancillary ground equipment on property located in an “A” Agricultural Zoning District. The Martin County Wireless Communications Facilities Ordinance/Zoning Ordinance requires a Conditional Use Permit for any new tower in an “A” Agricultural District.
