PUBLIC HEARING NOTICE
Planning Commission/Board of Adjustment
April 27, 2021
The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on April 27, 2021 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following items will be on the agenda:
Variance Request from Todd Steuber % Signature Swine within Section 13 of Fraser Township. Todd Steuber is proposing the construction of a new swine finishing confinement barn in an “A” Agricultural District which will be closer to a neighboring feedlot than the minimum required setback set forth in the Martin County Feedlot Ordinance. The Martin County Feedlot Ordinance requires a new animal feedlot (permitted after July 1, 1995) shall not be located within 1,320 feet (one-quarter mile) of a dwelling or an existing feedlot other than the operator’s or any business or industrial district as defined in this Ordinance and on the Zoning District Map.
Variance Request from Jerry Fast within Section 21 of Westford Township. Mr. Fast is proposing to replace an existing deck attached to an existing house encroaching closer than the minimum required setback from the centerline of the public right-of-way in an “A” Agricultural District. The Martin County Zoning Ordinance requires a 200 foot setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than 130 feet from the centerline in an “A” Agricultural District.
Variance Request from Mark Ufer within Section 28 of Waverly Township. Mr. Ufer is proposing to construct a new building that will be closer than the minimum required setback from side yard setback in an “A” Agricultural District. The Martin County Zoning Ordinance requires a side yard setback of not less than thirty (30) feet in an “A” Agricultural District.
Variance Request from James Dallager within Section 7 of East Chain Township. The Dallagers are proposing to build an addition which will replace an existing entry way and garage onto the east side of an existing house encroaching closer than the minimum required setback from the east sideyard setback in an “SL-2” Shoreland Residential Recreational District. The Martin County Zoning Ordinance requires a minimum setback of 30 feet from the sideyard setback in an “SL-2” Shoreland Residential Recreational District.
